Terms & Conditions of Sale and Service
1. Scope of Services
Xerus 3D Solutions provides additive manufacturing, 3D scanning, reverse engineering, design assistance, and related fabrication services based on information, specifications, drawings, measurements, and descriptions supplied by the client.
Unless explicitly agreed in writing, services do not constitute certified engineering design, safety validation, or regulatory approval.
2. Quotations and Acceptance
All quotations are valid for the period stated therein.
A binding agreement is formed upon written acceptance of a quotation or confirmation of order.
Xerus 3D Solutions reserves the right to decline orders at its discretion, particularly where safety, ethical, or technical concerns exist.
3. Pricing and Payment
All prices are exclusive of VAT unless otherwise stated.
Payment terms are as specified on the invoice.
Late payments may result in suspension of services.
4. Client Responsibilities
The client is responsible for:
- Providing accurate and complete specifications.
- Verifying the suitability of parts for their intended application.
- Proper installation, testing, and use of delivered components.
Where material selection is made against the recommendation of Xerus 3D Solutions, responsibility for performance remains with the client.
5. Materials and Manufacturing Process
Material properties are based on manufacturer data sheets and represent nominal values obtained under controlled testing conditions.
Due to the nature of additive manufacturing:
- Printed parts may exhibit anisotropic mechanical properties.
- Surface finish, dimensional tolerances, and strength characteristics may vary.
- Parts are not injection-moulded equivalents unless explicitly stated.
Unless otherwise agreed in writing, parts are considered custom-manufactured components and not certified for safety-critical or life-critical applications.
6. Prototypes and Functional Parts
Unless specifically agreed and documented otherwise, components supplied are not independently tested, certified, or approved for:
- Life-critical systems
- Structural load-bearing in regulated environments
- Pressure vessels
- Safety systems
Use in such applications is at the client’s own risk.
7. Limitation of Liability
To the fullest extent permitted by law:
- Xerus 3D Solutions’ liability is limited to the value of the invoice for the specific part or service supplied.
- Xerus 3D Solutions shall not be liable for indirect, incidental, special, or consequential damages, including but not limited to loss of production, downtime, profit loss, or third-party claims.
Nothing in these Terms excludes liability for gross negligence or willful misconduct where such exclusion is prohibited by law.
8. Intellectual Property
Unless otherwise agreed, intellectual property rights in custom designs remain with Xerus 3D Solutions until full payment has been received.
Client-provided files remain the property of the client. Xerus 3D Solutions assumes no liability for infringement resulting from client-provided designs.
9. Warranty
Custom-manufactured parts are warranted only against manufacturing defects for a period of 14 days from delivery.
No warranty is provided regarding fitness for a particular purpose unless explicitly agreed in writing.
10. Governing Law
These Terms & Conditions are governed by the laws of the Republic of Namibia.
